TERMS OF USE

The present Terms of Use (hereinafter "Terms") govern the use of the SyncSignal application and the related services provided by the company SYNC SIGNAL P.C., having its registered office at 23 Miaouli Street, Lykovrysi, Postal Code 14123, General Commercial Registry (G.E.MI.) No.: 187067403000, contact email: apps@syncsignalapp.com (hereinafter "Company", "we", "SyncSignal"). By installing, accessing, or using the SyncSignal application, the user ("you", "user") declares that they have read, understood, and fully accept these Terms and any additional updates or policies that may be communicated to them. If you do not agree with any of the Terms, you are not permitted to use the application or the services of SyncSignal.
A. PROVIDED SERVICES
1. The SyncSignal application constitutes a digital safety and support tool, designed to assist users in real or potential situations of danger. SyncSignal provides immediate alert, location sharing, and communication functions, aiming to enhance the user's personal safety.
2. The application allows the user to manually activate the Signal button in case they feel they are in danger or under threat. Upon activation:
- Real-time location and audio are sent to the user's selected "close friends" — the persons the user has designated in the application and who have explicitly accepted to receive their Signal notifications; Pro subscribers additionally stream video. More information regarding Close Friends can be found here.
- Relevant data is recorded for a limited period of time, in accordance with the Privacy Policy.
- Where the relevant feature is offered (it is not currently available), notifications are also sent to users located within a close radius.
- This function is intended exclusively for emergency situations and must not be used abusively. More information regarding the rules of use of the application and prohibited behaviors can be found here.
2a. The application also provides location-sharing functions outside emergencies: Quick Sync (a one-off share of the current position with a friend the user chooses) and Live Sync (continuous location sharing with friends the user selects, for a duration they set, freely revocable), as well as home-screen widgets and the ability to block users. Their usage rules are described in the Fair Use Policy.
3. The SyncSignal application may be used in principle by users over 15 years of age. The use of the application by minors under 15 years of age is prohibited.
4. The user understands and agrees that SyncSignal is solely a communication tool and under no circumstances constitutes a police service, immediate rescue or medical intervention service, or any governmental emergency service, nor does it cooperate with or have any affiliation with such services. Pressing the Signal button does not automatically notify any competent Authority, service, or body with an obligation to provide assistance — it notifies exclusively the close friends the user has approved (and, where the relevant feature is offered, other SyncSignal users nearby). SyncSignal does not guarantee that close friends and/or other users will respond to any Signal sent by the user.
The use of SyncSignal's services does not replace calling official emergency numbers (e.g. 112, 911, or local equivalents), and users are encouraged in every emergency or danger situation to immediately contact the relevant competent authorities.
B. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
1. The SyncSignal application, including the trade name, distinctive title, logo, interface design, software code, graphics, images, sounds, texts, functional features, and any other element comprising it, constitutes the intellectual and industrial property of SYNC SIGNAL P.C. and is protected by Greek and European legislation.
2. Without the prior written permission of the Company, the following are prohibited:
- Reproduction, copying, modification, translation, or creation of derivative works of the application or any part thereof.
- Disassembly, reverse engineering, or attempting to extract the source code.
- Commercial exploitation of the application or its content.
- Redistribution, sale, sublicensing, or granting of the application to third parties.
- Accessing the application via automated means, bots, or scripts without permission.
3. Any trademarks, logos, technical tools, APIs, libraries, or other third-party elements (e.g., Apple, Google, Firebase, AWS) used in the application constitute the intellectual and industrial property of their respective owners.
4. SyncSignal grants the user a personal, non-exclusive, non-transferable, and revocable license to use the application exclusively for private and lawful purposes. This license does not transfer any ownership or intellectual property rights to the user.
5. The Company reserves the right to take technical and legal measures to protect its intellectual property rights.
6. If the user provides any content (e.g., comments or feedback), they grant the Company a non-exclusive, worldwide, royalty-free license to use it for the improvement of services, without the transfer of any ownership right. SyncSignal does not claim ownership over content belonging to the user.
7. The name "SyncSignal", the application logo, and any related trademark or trade dress constitute registered or unregistered trademarks of the Company. Their use without the prior written permission of SyncSignal is prohibited.
C. SECURITY AND TECHNICAL LIMITATIONS
1. SyncSignal takes appropriate technical and organizational measures to protect the application and the data processed, in accordance with applicable security standards. However, no digital service can guarantee fully uninterrupted or invulnerable operation.
2. The operation of the application depends on third-party services, such as mobile network providers, push notification services, GPS satellite signals, cloud hosting services (e.g., Amazon Web Services and DigitalOcean), as well as device operating software (Android, iOS). SyncSignal is not liable for interruptions, delays, or malfunctions due to these third-party providers.
3. The Signal function may be affected by technical factors such as:
- absence of mobile signal or data,
- limited access to GPS,
- battery depletion or "low power mode" operation,
- device faults,
- incorrect notification settings.
SyncSignal cannot guarantee that Signal notifications will always be delivered on time or that all close friends will be available to respond.
4. SyncSignal does not substitute emergency services (such as 112) nor does it provide police or medical assistance services. There is no guarantee that close friends or any other users will respond, nor that they will receive or open the notification on time.
5. The application may be temporarily taken offline for maintenance, upgrades, or technical works. The Company will make efforts to minimize the duration and impact of such interruptions.
6. The user is responsible for:
- the proper operation of their device,
- installing application updates,
- enabling notifications, GPS, and data,
- the security of the device against malware.
The Company is not liable for malfunctions due to settings or faults of the user's device.
D. LIMITATION OF COMPANY LIABILITY
1. The SyncSignal application is provided "as is" and "as available". The Company makes every reasonable effort for its secure and smooth operation but provides no warranty that the application will operate continuously, error-free, or without technical limitations.
2. SyncSignal is not liable for damages due to:
- malfunction of the user's device (e.g., battery, hardware, operating system issues),
- presence of malware on the device,
- failure to enable GPS, notifications, or data,
- poor mobile signal or data reception,
- failure or delay of third-party services (Apple, Google, AWS, telecommunication providers, push notifications),
- delay or inability to receive Signal notifications by close friends or other users.
These factors are beyond the control of the Company.
3. SyncSignal may contain links to third-party websites (e.g., support forms, third-party provider terms). The Company bears no responsibility for the content, security, or privacy policies of these third-party websites.
4. SyncSignal does not replace official emergency services (such as 112), nor does it guarantee that close friends or any other users will respond or provide assistance. The user remains responsible for contacting the competent authorities immediately, where required.
5. The Company bears no liability for any action, omission, or behavior of a third party, including:
- close friends,
- other users of the application,
- persons obtaining access via shared device usage.
The Company is not liable for the misuse of data shared through the application by close friends or other recipients the user has approved.
6. SyncSignal is not liable for damages arising from:
- violation of these Terms or the Fair Use Policy by the user,
- false or malicious Signal activations,
- use for impermissible purposes,
- illegal, harmful, or unauthorized use of the application.
7. The Company is not liable for indirect, incidental, or consequential damages, such as loss of data, loss of device, physical or psychological harm, or financial loss, unless due to willful misconduct or gross negligence.
8. SyncSignal complies with all its legal obligations, including personal data protection. Any liability of the Company is limited to the extent permitted by applicable law.
E. SYNCSIGNAL PRO SUBSCRIPTION
1. The application's core functionality (including the Signal button with live audio and up to two close friends) is provided free of charge. The optional SyncSignal Pro subscription additionally provides: video streaming upon Signal activation, and up to five (5) close friends.
2. The subscription is monthly, auto-renewing, priced at €1.99 per month (the final price is always displayed in the store before purchase). Billing is handled exclusively through your Apple App Store or Google Play account, under the terms of the respective store. The Company does not collect or store card details.
3. A one (1) month free trial is offered to new subscribers. When it ends, the subscription automatically converts to a paid one, unless cancelled at least 24 hours earlier.
4. The subscription renews automatically every month unless cancelled at least 24 hours before the end of the current period, through the subscription settings of the App Store or Google Play. After cancellation, Pro benefits remain active until the end of the period already paid for.
5. Any refunds are governed by the terms and procedures of the respective store. Consumer rights under EU and Greek law are not affected.
6. The Company may change the price or content of the subscription for future billing periods, with timely prior notice to subscribers.
F. PERSONAL DATA
The protection of your personal data is extremely important to us. We respect your right to confidentiality and have taken all necessary precautions to protect your personal information from loss, theft, and misuse, as well as from unauthorized access, disclosure, alteration, and destruction. G. GENERAL TERMS
1. The Company reserves the right to modify and update these Terms, either in whole or in part, at its absolute discretion at any time. Modifications enter into force from the date of their notification to the user, which takes place via the registered email. The date of the last modification will always appear at the top of this page. In case of disagreement with the modifications, you may deactivate your account. Continued use of the application following the update is deemed to constitute acceptance of the modified Terms.
2. Any invalidity of some of these Terms does not bring about the invalidity of the rest. If any provision of these terms of use is deemed illegal, void, or unenforceable, then that provision may be severed without affecting the enforceability of all other provisions.
3. The non-exercise by the Company of its rights arising from these Terms does not imply a waiver of those rights.
4. The Company is not liable for a breach of these Terms due to reasons of force majeure.
5. These terms of use shall be interpreted in accordance with Greek law, and for any dispute or need for interpretation that may arise, the courts of Athens shall be competent.
